1. Agreement to these terms

By requesting a quote, making a booking, granting us access to your property, or otherwise engaging the services of Vac Aqua Wash Pty Ltd (“we”, “us” or “our”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please contact us at ceo@vacaquawash.site before confirming a booking so we can address your concerns.

2. Who we are

Vac Aqua Wash Pty Ltd is an Australian proprietary company registered in Western Australia under ABN 94 701 288 020. We operate from Perth, WA and provide vacuum and aquatic cleaning services, including pool cleaning, pond and water feature maintenance, rainwater tank cleaning, and wet and dry vacuum extraction for residential, strata and commercial clients.

3. Our services

The services we provide are those described on our Services page and in any written quote we issue to you. Unless expressly agreed in writing, our quotes cover only the items listed. Any additional work requested on site, or identified as reasonably necessary to complete the job safely, may be quoted separately before it is carried out.

4. Quotes and bookings

  • Written quotes are valid for 30 days from the date of issue unless otherwise stated.
  • Quotes are based on the information you provide and, where applicable, a site inspection. Final pricing may change if actual site conditions differ materially from those described.
  • A booking is confirmed once we accept your requested date and, where required, receive the applicable deposit.
  • Times provided for attendance are estimates. We will make reasonable efforts to arrive within the agreed window, but traffic, weather and prior jobs may cause delays.

5. Payment terms

  • Invoices are payable within 7 days of issue unless another arrangement is stated on your quote or invoice.
  • Prices are quoted in Australian dollars and include GST where applicable.
  • Overdue amounts may attract interest or an administrative late fee to the extent permitted by Western Australian law.
  • We may suspend further services, or require payment in advance, while any invoice remains overdue.

6. Cancellations and rescheduling

We understand plans change. Please give us at least 24 hours’ notice if you need to cancel or reschedule a booking. Cancellations made with less than 24 hours’ notice, or where we attend a site and cannot gain access, may attract a call-out or cancellation fee to cover labour, travel and scheduling costs. Where extreme weather or other events beyond our control force a rescheduling, we will work with you to rebook at the earliest practical date at no penalty.

7. Access and client responsibilities

  • You must provide safe, reasonable access to the work area at the agreed time, including access to water and power supply where the service requires it.
  • You must tell us, before work begins, about any hazards on or near the site, including structural damage, electrical risks, aggressive animals, chemical storage or unstable ground.
  • Pets should be secured away from the work area for their safety and the safety of our technicians.
  • You are responsible for removing or protecting fragile or valuable items near the work area.

8. Aquatic environments and site safety

Work on pools, ponds, water features and tanks carries inherent risks. Our technicians are trained to assess conditions before and during work. If we consider an environment unsafe, we may pause or stop work until conditions are made safe. We will always communicate the reason and, where possible, offer an alternative approach or a revised booking. Work may also be paused where water chemistry, water level or equipment condition makes the service ineffective or unsafe.

9. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth), or any other law that cannot lawfully be excluded.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to have the services supplied again or, for a major failure, to a refund. You may also be entitled to compensation for any other loss or damage that is reasonably foreseeable and caused by our failure to comply with a consumer guarantee. For goods and services not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, to the extent permitted by law, to resupplying the services or paying the cost of having the services supplied again.

10. Liability

To the extent permitted by law and subject to the consumer guarantees described above, we are not liable for indirect, special or consequential loss, including loss of profit or enjoyment of the premises. We are not responsible for pre-existing damage or defects, such as cracked pool shells, failing pumps, deteriorated liners, or equipment that fails independently of our work. Where our services cause damage and we are liable, our liability is limited to the cost of repairing or replacing the affected item, or resupplying the service, in accordance with the Australian Consumer Law.

11. Indemnity

You agree to indemnify us against loss, damage or liability arising from your breach of these terms, from information you provide that is inaccurate or incomplete, or from site hazards that you knew about and did not disclose to us before work commenced.

12. Privacy

We handle personal information in accordance with our Privacy Policy. That policy explains what information we collect, why we collect it, how we store it and how you can request access or correction.

13. Intellectual property

All content on this website, including text, layout and branding, is owned by or licensed to Vac Aqua Wash Pty Ltd and is protected by Australian copyright law. You may not reproduce or reuse our content commercially without our written permission.

14. Events beyond our control

We are not liable for delay or failure to perform our services where the cause is beyond our reasonable control, including storms, flooding, power outages, water restrictions, government directions, or the unavailability of equipment or supplies. Where such an event occurs, we will notify you promptly and reschedule the affected work.

15. Suspension and termination

Either party may end an ongoing service arrangement by giving 14 days’ written notice by email. We may suspend or end services immediately, with notice to you, if payment is overdue, if site conditions are unsafe and cannot be remedied, or if our staff or contractors are subjected to abusive or unsafe behaviour.

16. Changes to these terms

We may update these Terms of Service from time to time. The current version is always published on this page with its last-updated date. The terms that apply to your booking are the terms in force on the date your booking is confirmed, except where a later version is required by law.

17. Governing law and disputes

These terms are governed by the laws of Western Australia. If a dispute arises, we ask that you contact us first so we can work towards a fair resolution in good faith. Nothing in this clause limits your rights under the Australian Consumer Law, including your right to escalate a consumer matter to the relevant authority.
